Announcement on the elimination of customs duties on Marketization of tariff goods in the US and Canada

In accordance with the laws and regulations of the Customs Law of the People's Republic of China and the regulations on import and export duties of People's Republic of China, we hereby announce the following procedures for the import and export clearance of tariffs on commodities in the US and Canada (hereinafter referred to as "market exclusion").

I. date of implementation

Since March 2, 2020, the Customs has accepted marketization to exclude import declaration of customs declaration.

Two, customs declaration specification

The consignee who has obtained the marketization and exclude the number, when declaring to exclude the goods, shall choose the counteraction measures to exclude the code "0" from the "code code" column under the item "attached documents and numbering" of the customs declaration form, and enter the 18 digit exclusion number in the "document number" column, and the related commodities will no longer impose a counteract tariff on the United States 301 measures.

If the consignee fails to fill in the exclude number when declaring the declaration, the relevant customs declaration products will impose additional duties if it involves adding 301 tariff counteracts to the US.

Three, automatic removal matters

When importing goods originating in the United States in compliance with the tax relief policy, the consignee shall declare the number of customs import and export duty exemption certificate issued by the Customs on the column number of the customs declaration, and automatically exclude the 301 tariff counter-measures.

Low value goods express (category C express) products imported from the US in the Central Plains will automatically exclude the 301 tariff counteract against the United States.

Other exclusion measures that have been implemented and within the validity period will still go through the customs formalities according to the existing regulations. They will automatically exclude the anti tariff measures imposed on the US 301 measures and do not need to fill in the numbers and exclude the numbers.

Four. About security and other related matters.

Since March 2, 2020, the consignee has declared that the import is related to the 301 measures to counteract tariffs on the United States. If we do not get the exclude number, we can apply to the Customs for tax relief to release the goods first. The customs shall not accept the application of any market removal measures after the release to the customs, and the tax levy shall not be adjusted.

In March 2, 2020, a commodity that was originally imported from the United States was declared to be imported and was in line with the tax relief policy. The certificate issued by the customs and Excise Department of the customs and Excise Department (hereinafter referred to as "tax exemption certificate") has already included the 301 tariff counteract for the United States. The tax exempt applicant may apply to the competent customs for a change of the certificate of tax exemption.
