In April 10th, the website of the State Energy Bureau announced a public consultation on the energy law of the People's Republic of China (Draft). Before May 9, 2020, the relevant units and people from all walks of life put forward valuable opinions and suggestions on the "People's Republic of China Energy Law (Draft)" by e-mail (yijian@nea.gov.cn).

　　 Since 2017, under the guidance of the former Legislative Affairs Office of the State Council and the Ministry of justice, the national development and Reform Commission and the State Energy Bureau have organized an expert group and a special work class to further improve and perfect the revised version of the People's Republic of China Energy Law (Draft), and form a new People's Republic of China Energy Law (Draft).

The relevant units and people from all walks of life are welcome to put forward valuable opinions and suggestions on the People's Republic of China Energy Law (Draft) before May 9, 2020 by e-mail (yijian@nea.gov.cn).

The draft proposed that the State encourage efficient, clean development and utilization of energy resources, support the priority development of renewable energy, rationally develop fossil energy resources, develop distributed energy in line with local conditions, promote non fossil energy to replace fossil energy and low carbon energy instead of high carbon energy, and support the development and Application of new fuels and industrial raw materials instead of oil and natural gas.

According to the draft, the development and processing transformation of coal, oil and natural gas should follow the principles of safety, green, intensive and efficient, and improve the recovery rate of resources and the level of clean and efficient development and utilization.

The draft is encouraged to develop circular economy in coal mining areas, promote clean and efficient utilization of coal, and appropriately develop coal fuel and chemical raw materials. The State encourages large-scale, advanced and intensive oil processing conversion mode, and optimizes the layout and structure of petroleum processing transformation industry.

The legal system to be set up for the draft is mainly as follows: first, guide the development and utilization of energy through strategy and planning, and promote clean and low-carbon development of energy; two, promote the development of energy and the construction of energy infrastructure and improve the energy supply capability; three, improve the universal service mechanism of energy through the protection of people's livelihood and the need for energy; four, comprehensively promote the creation of science and technology. The five is to support the reform of energy system and mechanism, and comprehensively promote energy marketization; the six is to establish an energy reserve system, to strengthen emergency response capacity building, and to ensure energy security; seven, to strengthen supervision and management of energy development and utilization according to law, to improve the regulatory system, and to promote the modernization of energy management system and governance capacity.

It is reported that for a long time, the basic law of energy is absent. The energy law is formulated. First, we need to push forward the new strategy of "four revolutions and one cooperation" for energy security. The two is the urgent need to promote the development of high quality energy. The three is the urgent need to promote the modernization of energy governance system and governance capacity.
